1. ACCEPTANANCE OF TERMS

By accessing our website , engaging our property management services, or utilizing our concierge services, you agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our services.

SW FL Property Management Solutions we reserve the right to modify these terms at any time. Changes will be made  effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modifications. 

 

2. SERVICES PROVIDED

SW FL Property Management Solutions offers comprehensive property management and concierge services in Southwest Florida , including but limited to:

 * Residential property management for owners and landlords

 * Tenant screening , placement, and lease administration

 * Rent collection and financial reporting 

 * Property maintenance coordination and oversight

 * 24/7 emergency maintenance services 

 * Concierge services for property owners and tenants 

 * Property inspection and condition reports

 * Vendor management and contract negotiation 

Specific services and scope of work will be detailed in individual service agreements with clients.

3. PROPERTY OWNER RESPONSIBILITIES

Property owners who engage in our services agree to: 

 * Provide accurate and complete information about the property and its condition 

 * Maintain appropriate insurance coverage for the property 

 * Ensure the property complies with all applicable federal , state, and local laws, including fair housing regulations

 * Authorize the Company to act on their behalf in matters related to property management

 * Maintain sufficient funds for property-related to property expenses and emergency repairs 

 * Respond promptly to requests for decisions regarding the property 

 * Pay management fees and expenses as outlined in the service agreement

4. TENANT RESPONSIBILITIES

Tenants residing in properties managed by SW FL Property Management Solutions agree to: 

 * Pay rent in full and on time as specified in the lease agreement 

 * Maintain the property in good condition and report maintenance issues promptly 

 * Comply with all lease terms and property rules

 * Allow access for inspections and repairs with proper notice 

 * Provide accurate information during the application process

 * Respect the rights of neighbors and other residents

 * Not engage in illegal activities on the premises 

5. FEES AND PAYMENT TERMS

Management Fees 

Property management fees and payment terms will be specified in individual service agreements. Fees may include but are not limited to:

 * Monthly management fees ( typically a percentage of collected rent ) 

 * Tenant placement fees

 * Lease renewal fees

 * Coordination fees for maintenance  and repairs 

 * Concierge service fees

Payment Processing 

All fees are due as specified in the service agreement. Late payments may incur additional charges. The Company reserves the right to suspend services for non-payment.

6. MAINTENANCE AND REPAIRS

Emergency Repairs 

The Company is authorized to arrange emergency repairs up to limits specified in the service agreement to protect the property and ensure tenant safety. Property owners will be notified as soon as possible. 

Non Emergency Repairs

For non- emergency repairs exceeding agreed-upon limits, the Company will obtain owner approval before proceeding, except where delay would cause further damage to the property.

Vendor Selection

The Company will use reasonable care in selecting qualified vendors but is not liable for the quality of vendor work beyond arranging appropriate corrections when deficiencies are identified.

7. LIABILITY AND INDEMNIFICATION

Important Notice: This section contains important limitations on our liability. Please read carefully.

Limitation of Liability 

To the maximum extent permitted by law, SW FL Property Management Solutions shall not be liable for: 

 * Acts or omissions of tenants, vendors, contractors, or other third parties

 * Property damage resulting from natural disasters, tenant actions, or circumstance beyond our reasonable control

 * Loss of rent due to tenant default or property vacancy

 * Consequential, indirect, incidental, or punitive damages

 * Any claims exceeding the management fees paid during the six months proceeding the claim

Indemnification

Property owners agree to indemnify and hold harmless SW FL Property Management Solutions, its officers, employees, and agents from any claims, damages, or expenses arising from: 

 * Property conditions or defects

 * Violation of laws or regulations related to the property 

 * Injuries occurring on the property 

 * Actions taken by the Company at the owner's direction 

8. INSURANCE REQUIREMNTS

Property owners are required to maintain adequate property insurance, including liability coverage. The Company maintains errors and omissions insurance but this does not substitute for the owner's property insurance obligations.

Tenants are strongly encouraged to maintain renters insurance to protect their personal property and liability exposure.

9. TERMINATION OF SERVICES 

By Property Owner

Property owners may terminate management services with written notice specified in the service agreement. Early termination may result in fees as outlined in the agreement 

By the Company

The Company may terminate with appropriate notice if:

 * The property owner breaches the service agreement 

 * Fees remain unpaid after notice

 * The property condition or owner demands make management impractical 

 * Required by law or professional standards

Upon Termination 

Upon Termination, the Company will provide a final accounting, transfer tenant security deposits, and return all property-related documents and funds, less an

10. CONFIDENTIALITY AND DATA PROTECTION

The Company will maintain the confidentiality of client information in accordance with our Privacy Policy and applicable law. However, information may be disclosed when:

 * Required by law or legal process

 * Necessary to provide services ( e.g. , sharing tenant information with property owners )

 * Authorized by the client

11. FAIR HOUSING COMPLIANCE

SW FL Property Management solutions is committed to full compliance with the Fair Housing Act and all applicable fair housing laws. We do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, or any other protected class.

All tenant screening and selection is based on legitimate, non-discriminatory criteria applied consistently to all applicants.

12. WEBSITE USE AND INTELLECTUAL PROPERTY

WEBSITE TERMS:

Our website is provided for informational purposes. While we strive for accuracy , we make no warranties regarding the completeness or accuracy of website content.

INTELLECTUAL PROPERTY:

All content on our website, including text, graphics, logos, and images, are the property of SW FL Property Management Solutions or its content suppliers are protected by copyright and trademark laws.

PROHIBITED USES:

You may not use our website or services to:

 * Violate any laws or regulations

 * Transmit harmful or malicious code

 * Impersonate any person or entity

 * Collect information about others without consent

 * Interfere with the proper functioning of the website

13. DISPUTE RESOLUTION

GOVERNING LAWS:

These terms and conditions shall be governed  by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law provisions.

MEDIATION AND ARBITRATION:

In the event of a dispute, the parties agree to first attempt  resolution through good faith negotiation. If unsuccessful, disputes may be submitted to mediation before pursuing litigation or arbitration as specified in individual service agreements.

VENUE:

Any legal action arising from these terms shall be brought exclusively in the courts of Sarasota County, Florida.

14. SEVERABILITY

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the maximum extent necessary so that the remaining terms remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms and Conditions, together with any executed service agreements and our Privacy Policy, constitute the entire agreement between you and SW FL Property Management Solutions regarding the use of our services.

16. EMERGENCY CONTACT

For property emergencies requiring immediate attention ( such as flooding, fire, gas leaks, or security issues ), contact our 24/7 emergency line. Non-emergency matters should be submitted through normal business channels.
